Article V. CUMBERLAND SPECIAL SERVICES DISTRICT NO. I |
§ 114-94. Recreational and sports tourism services fee.
A recreational and sports tourism services fee ("services fee" or "fee") is levied on the per night rate of all hotel rooms in the district to pay, wholly or partially, the cost of providing, supplementing or enhancing local government services within the district and to construct and maintain facilities therefor, which thereby will enhance recreation, sports, tourism and commercial opportunities for visitors to and guests of the district. The amount of this fee shall be fair and reasonable, bearing a substantial relationship to the services offered to all individuals or entities paying such fee.
The proceeds of the services fee shall be used to pay, wholly or partially, the cost of providing, supplementing or enhancing local government services within the district and to construct and maintain facilities therefor, which local government services may include, but not be limited to, the following:
(1)
Primarily to develop, construct, operate and maintain a new multi- purpose recreation, sports and public entertainment stadium and coliseum facility that will, among other benefits:
a.
Foster and improve recreational areas, programs, and facilities within the district;
b.
Promote and enhance entertainment, economic development and tourism opportunities; and
c.
Augment and supplement parking facilities within the district.
(2)
To effect additional services and facilities that comprise or enhance any transportation and infrastructure component of the coliseum project or the commercial development.
(3)
To establish and operate within the district, a public circulator transportation system that will, among other benefits:
a.
Confer more direct and easier access to the coliseum project site and the commercial development, as defined herein;
b.
Provide a means of travel within and around the district for individuals who seek transportation by means other than automobile;
c.
Improve and enhance within the district the county's current public transportation system; and
d.
Reduce vehicular traffic within the district, reduce the impact to district roadways and thoroughfares, and reduce pollution and other environmental irritants, all through lowering the volume of automobiles on district roadways.
Local government services and facilities to be funded by the services fee assessed within the district will benefit those responsible for payment of the fee beyond the costs of such local government services and facilities and beyond the amount of the fee itself.
