§ 118-166. Definitions.

  • The following words, terms and phrases, when used in this division, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    American National Standards Institute specifications or ANSI Standards means sections 3 and 4 of the ANSI specifications A117.1—1986, for making building and facilities accessible to and usable by handicapped individuals.

    Counterfeit means any copy of any kind of handicapped parking permit which is not authorized by or does not carry the official seal of the state department of public safety.

    Enforcement officer means any duly authorized law enforcement officer employed by the county.

    Facilities includes, but is not limited to, walkways, sidewalks, curbing, parking lots, parks, stadiums, coliseums, and any other manmade or developed area used by the public.

    Government buildings means all buildings, structures, streets, sidewalks, walkways, and access thereto, which are used by the public or in which handicapped or elderly persons may be employed, that are constructed, leased, or renovated in whole or in part by use of state or county funds to the extent not required otherwise by federal law or regulations and not beyond the power of the county or state to regulate; all buildings and structures used by the public which are constructed or renovated in whole or in part by use of federal funds.

    Handicapped parking permit means any form of permit issued by the state department of public safety, or proper authority in another state, pursuant to O.C.G.A. §§ 40-6-222 and 40-6-223, as amended, or under section 118-181 of this chapter.

    Handicapped parking place means any area on public or private property which has been designated as reserved for use of handicapped persons pursuant to O.C.G.A. § 40-6-221(2), as amended.

    Handicapped person means a person who, by reason of illness, injury, age, congenital malfunction, or other incapacity or disability, has a significant loss or impairment of mobility.

    Institution means an institution for which a permit or conditional handicapped parking permit may be issued under O.C.G.A. § 31-7-1, as amended.

    Permanently handicapped person means a handicapped person whose disability or incapacity can be expected to last for more than 180 days.

    Property owner means any person or entity of any kind possessing any estate, usufruct or leasehold right in the property being designated for handicapped parking.

    Ramp means any ramp or curb ramp as defined in ANSI A117.1—1986.

    Return mail parking citation means an order issued out of court, by an enforcement officer of the county, directing a violator of this article to comply with all administrative penalties as set forth.

    Temporarily handicapped person means a handicapped person whose disability or incapacity can be expected to last for not more than 180 days.
