§ 122-46. Revocation of permit.

  • (a)

    County discharge permits issued in accordance with the provisions of this article may be suspended, revoked or denied for any of the violations set forth in subsection 122-184(h)(2).

    (b)

    In addition to the provisions set forth in subsection 122-184(h)(2), conditions resulting in termination of water and wastewater service may include but not be limited to:

    (1)

    Violation of wastewater discharge permit conditions;

    (2)

    Failure to accurately report the wastewater constituents and characteristics of its discharge;

    (3)

    Failure to report significant changes in operation or wastewater volume constituents, and characteristics prior to discharge;

    (4)

    Refusal of reasonable access to the user's premises for the purposes of inspection, monitoring or sampling; or

    (5)

    Violation of pretreatment standards in division 6 of this article.

    Where this action does not conflict with section 122-52, such user will be notified of the proposed termination of its discharge and be offered an opportunity to show cause under section 122-44 why the proposed action should not be taken. Exercise of this option by the department director shall not be a bar to, or be a prerequisite for, taking other actions against the user.
