§ 130-29. Boating safety zones; creation and restriction.

  • (a)

    Lake Acworth is hereby declared to be a boating safety zone, upon certification and approval by the state department of natural resources. Upon approval, no gasoline or diesel powered motor, engine or other such equipment shall be operated on such lake. In addition thereto, the speed limit on such lake shall not exceed a speed of ten miles per hour.

    (b)

    The portion of Lake Allatoona that lies within the boundaries of the county is hereby declared to be a boating safety zone, upon certification and approval of the state department of natural resources.

    (c)

    The portion of the Chattahoochee River that lies within the boundaries of the county is hereby declared to be a boating safety zone, upon certification and approval of the state department of natural resources.

    (d)

    Additional boating safety zones within the county may be established from time to time.

    (e)

    This section shall apply to model boats operated within the safety zones established by this section.

    (f)

    The safety zones established by this section will be governed by and will adhere to the Georgia Boat Safety Act, being O.C.G.A. § 52-7-1 et seq., concerning lifesaving devices for vessels, as well as any other applicable portions of the Georgia Boat Safety Act, i.e., definitions, speeds and boating while intoxicated, etc.

    (g)

    This section shall not apply to lifesaving, emergency, law enforcement or maintenance boats or equipment.
