§ 134-376. Severability.

  • (a)

    It is hereby declared to be the intention of the governing authority that the sections, paragraphs, sentences, clauses and phrases of this article are severable, and if any phrase, clause, sentence, paragraph or section of this article shall be declared unconstitutional or invalid by judgment or decree of any court of competent jurisdiction, the unconstitutional or invalid phrase, clause, sentence, paragraph shall be struck and the remaining phrases, clauses, sentences, paragraphs, and sections shall be effective as if the unconstitutional or invalid portion had not existed.

    (b)

    If any provision of this article conflicts with any other provision of this article or its amendments as adopted by the governing authority, or with any other applicable ordinance, statute, or law, the provision that contains the more stringent regulation shall be enforced.
