§ 50-26. Definitions.
The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
Chattahoochee River Corridor Tributary Protection Area or protection area is defined and established to be the stream channel and the land area extending outward 25 horizontal feet from the top of the banks on each side of all flowing tributaries of the Chattahoochee River downstream from Buford Dam and upstream from State Road 3 and located outside of the stream corridor.
Director means the director of community development or his designee.
Flowing tributaries means those tributaries of the Chattahoochee River which are streams or creeks which are designated and shown as perennial streams on the 7.5-minute quadrangle maps of the U.S. Department of the Interior, U.S. Geological Survey, as amended by the U.S. Geological Survey from time to time. All designated protection areas shall be shown on an official map of unincorporated Cobb County. In case of conflict, the U.S. Geological Survey map will control.
Land disturbing activity means the scraping, plowing, clearing, dredging, grading, excavating, transporting or filling of land or placement of any structure or impervious surface, dam, obstruction or deposit, but shall not include ordinary landscape maintenance.
Parcel means any plot, lot or acreage owned, leased or rented by a person.
Person means any individual, partnership, corporation, trust or entity, whether public or private.
Stream corridor means all land in unincorporated Cobb County upstream of Georgia State Route 3 in the county within 2,000 feet of the watercourse or within the 100-year floodplain, whichever is greater.
Watercourse means the banks of the Chattahoochee River, including any impoundments thereon, in the area as defined by the low water mark of such stream and any impoundments and including the entire bed of such stream and any impoundments and all islands therein, from the point where the stream enters the area downstream to a line perpendicular across the flow of such stream at the point within the area which is the last downstream water supply intake location for any political subdivision in the area.
