§ 50-127. Permit requirements.

  • (a)

    No building, grading or ground disturbance permit shall be issued or modified without the following:

    (1)

    A security acceptable to the county attorney as required by section 50-144.

    (2)

    Recorded easements for regional stormwater management facilities as required by sections 50-141(a) and 50-143.

    (3)

    An approved stormwater management design plan; provided, that the manager may accept a stormwater management concept plan if it identifies the location and type of facilities to be constructed in sufficient detail to accurately estimate construction costs. If such concept plan is approved by the manager, a final design plan must be submitted to and approved by the director no later than 30 days thereafter.

    (4)

    An inspection and maintenance agreement shall be executed by the landowner for all private, on-site stormwater management facilities prior to the issuance of any building, grading, land disturbance permits or certificate of occupancy.

    (b)

    Notwithstanding any of the provisions in this section, the manager may require an approved stormwater design plan and the recordation of all necessary easements prior to issuance of a building, grading or land disturbance permit.

    (c)

    In no event shall a use and occupancy permit be granted prior to the approval of a stormwater design plan, and an executed maintenance agreement if such agreement is required by subsection (a)(4) of this section or by section 50-161.

    (d)

    Approved stormwater design plans shall contain certification by the applicant that all land clearing, construction, development and drainage will be done according to the plan or previously approved revisions. Any and all building, grading or land disturbance permits and/or use and occupancy certificates or permits may be revoked at any time if the construction and maintenance of stormwater management facilities are not in strict accordance with approved plans and/or maintenance agreements.
