§ 50-188. Variances.
(a)
The director may grant a variance from the requirements of this article not pertaining to illicit discharge and illegal connections, if exceptional circumstances applicable to a site exist such that strict adherence to the provisions of this article will result in unnecessary hardship and will not fulfill the intent of this article.
(b)
A written request for a variance from the requirements of this article shall be required and shall state the specific variance sought and the reasons, with supporting data, a variance should be granted. The request shall include all information necessary to evaluate the proposed variance.
(c)
The director will conduct a review of the request for a variance within 20 working days of receiving the request.
(d)
The illicit discharge and illegal connection portions of this article are not subject to hardship variances, or to "grandfather" provisions. Past, present and/or proposed illicit discharges and illegal connections are deemed to be against the law and counter to public health, safety and welfare. Therefore the director cannot grant variances from the requirements of this article pertaining to illicit discharge and illegal connections.
