§ 50-190. Runoff quantity controls.
(a)
Water quantity controls will be provided as a part of all development pursuant to the provisions of articles III and IV of this chapter and chapters 110 (subdivisions) and 134 (zoning) and, upon adoption of this article.
(b)
The county may allow stormwater runoff that otherwise is of unacceptable quantity or which would be discharged in volumes or at rates in excess of those otherwise allowed by this article and other ordinances, to be discharged into drainage facilities off-site of the development, provided the following conditions are met:
(1)
It is not practicable to completely manage runoff on-site in a manner that meets the design and performance standards found in this article, and the county soil erosion and sedimentation and design manuals;
(2)
Off-site drainage facilities and channels leading to them are designed, constructed and maintained in accordance with requirements of those ordinances; and
(3)
Adequate provision is made for sharing of construction, maintenance and operating costs of facilities.
