§ 6-147.1. Administrative penalty.

  • (a)

    In lieu of the suspensions set out in section 6-147(c), a business holding the license under which the violation occurred may elect to pay an administrative penalty in accordance with the following schedule:

    (1)

    An administrative penalty of $750.00 for the first offense of the violations set forth in section 6-147(a).

    (2)

    An administrative penalty of $750.00 per day for each day of the corresponding suspension, if a second violation of section 6-147(a) occurs within the 12-month period immediately preceding the violation.

    (3)

    An administrative penalty of $750.00 per day for each day of the corresponding suspension, if a third violation of section 6-147(a) occurs within the 12-month period immediately preceding the violation.

    (4)

    An administrative penalty of $750.00 per day for each day of the corresponding suspension, if a fourth violation of section 6-147(a) occurs within the 12-month period immediately preceding the violation.

    (b)

    In addition to the appeal process set forth in section 6-147(d), if a business finds the above administrative penalties overly burdensome, the business may appeal the administrative penalty and request a hearing before the Cobb County Board of Commissioners regarding the amount of the administrative penalty. The business has the burden of proof to show a financial hardship.
