§ 78-96. Business license and food service permit required.
(a)
It shall be unlawful for any person to sell, or offer for sale, food of any type from a commissary or mobile retail food establishment without a business license first having been granted under this section by the business license division manager or his/her designee, and without a valid food service permit first having been obtained from the Cobb and Douglas Public Health Department ("health department").
(b)
Prior to the issuance of a business license under this subdivision II, an application for a food service permit(s) by a mobile food vendor, setting forth all required information, shall be submitted to the health department in accordance with its mobile/extended service units permit applications and the BOH food services rules and regulations.
(c)
The business license division manager shall require proof (a copy) of the food service permit from the health department prior to the issuance of a business license to a mobile food vendor.
(d)
A mobile food vendor(s) operating on county or other public property at the invitation or request of one or several of the authorized individuals specified in section 78-97(d) shall not be required to obtain a business license hereunder for such county or public entity sponsored event but must comply with all other requirements of this subdivision II.
