§ 78-356. General disqualifications of applicant.
No license shall be granted under this division where the application or the evidence shows any of the following conditions to exist:
(1)
That the applicant has been convicted of or pled guilty or nolo contendere to a specified criminal activity, as defined by this division.
(2)
That the applicant is a ward with a conservator or guardian.
(3)
That the applicant, as a previous holder of a license for an adult entertainment establishment, has violated any law, regulation or ordinance relating to such business within a ten-year period immediately preceding the date of application.
(4)
That any applicant, or any corporation, partnership or other legal business entity, of which the applicant is or was an officer, director, shareholder, general partner, managing agent or chief administrative official, is delinquent in payment of any property tax or other tax or license fee payable to the county or to the state.
(5)
If it is determined that the applicant is making application for a license for another person, corporation, partnership or other legal business entity who could not otherwise qualify for a license in order to act as a guise, dummy or straw-man for that person, corporation, partnership or other legal business entity who otherwise could not qualify for a license.
(6)
An applicant is less than 18 years of age.
(7)
An applicant has failed to provide information required by this division for issuance of a license or has falsely answered a question or request for information on the application form.
(8)
The adult entertainment establishment is not in compliance with the interior configuration requirements of this division or is not in compliance with locational requirements of this division or the location requirements of any other part of this Code or state law.
(9)
For the purposes of this section applicant shall include, the person or entity making the application, any partners, corporate officers, directors or shareholders of the applicant or any of their spouses.
