§ 78-365. Causes for mandatory denial.

  • (a)

    No license shall be issued to an applicant under this division if one or more of the following shall have occurred:

    (1)

    The same applicant for a license or renewal has been rejected for any location, if such rejection was based upon the applicant's failure to meet the terms of this division applicable to the applicant as opposed to rejection for reasons related to the location itself, provided that the reason or reasons for the applicant's failure to meet the terms of this division still exist(s).

    (2)

    When any application for a license to transact business within the control of the police powers is revoked for cause by the board of commissioners within ten years immediately preceding the filing of the application.
