§ 83-29. Agreed abatement plan; temporary order.

  • If the recipient of a notice under section 83-27 enters into an agreed-upon abatement plan to prevent the conduct constituting the public safety nuisance within 30 days of service of the notice and complies and maintains compliance with the agreement during the stipulated time period, the county attorney may:

    (a)

    Refrain from filing a petition for abatement on the specified property, or

    (b)

    File a petition for abatement and propose to the court the entry of an order containing the terms of the abatement plan, or

    (c)

    Take such other discretionary measures necessary to snare the public safety nuisance.
