§ 10-120. Sales of personal property.

  • All sales of personal property upon all processes from this court in Cobb County shall take place before the courthouse door of Cobb County between the hours of 10:00 a.m. and 4:00 p.m. at public outcry, on the Monday next following ten days' advertisement by notice posted at the courthouse door describing the property to be sold, the place and hour of sale, the name and residence of the owner of such property, if known to the levying officer, the style of the case in which the execution was issued and the location of the place where the property was seized. The names and addresses of every purchaser at any sale conducted by an officer of this court shall be furnished in writing by such officer to the clerk and kept by him in some proper record accessible to the public. Any sale may be conducted by the sheriff or a deputy sheriff of Cobb County, provided, that in all cases where execution or other processes from this court are levied upon real estate, said real estate shall be advertised and sold in the manner and form, and at the time and under the conditions now prescribed by law. Sales of perishable property and sales of personalty on the premises may be made under the rules relating to such sales in the superior courts of this state.
